CUPERTINO, Calif. (AP) - Apple says it will sell an iPad with more memory than the current models available.

Apple Inc. said Tuesday that the new, full-size model comes with 128 gigabytes of memory, up from 64 gigabytes. Nothing else has changed, so it will remain a fourth-generation iPad, which went on sale in November. The memory increase does not apply to the iPad Mini, which also went on sale in November.

The new iPad will go on sale on Feb. 5 for $799 for a Wi-Fi model and $929 with cellular data access as well.

Apple says it has sold more than 120 million iPads since their debut in April 2010. The latest iPads with 16, 32 and 64 gigabytes remain available, starting at $499. The older iPad 2 starts at $399.

Dr. Phil says Manti Te'o hoaxer admits to love for linebacker

LOS ANGELES (Reuters) - A California man who has admitted to fabricating Notre Dame linebacker Manti Te'o's fake girlfriend in an elaborate hoax told talk show host Phil McGraw he felt a deep romantic love for the football player, McGraw said on Wednesday.

"Here we have a young man that fell deeply, romantically in love," McGraw told the television morning show "Today" to discuss his two part interview with Ronaiah Tuiasosopo, which will air on "Dr. Phil" on Thursday and Friday.

"I asked him straight up, 'Was this a romantic relationship with you?,' and he says yes. I said, 'Are you then therefore gay?' And he said, 'When you put it that way, yes.' And then he caught himself and said, 'I am confused,'" McGraw told "Today."

Te'o has said in a previous media interview he is not gay.

The fake girlfriend hoax involving Te'o, who was a finalist for college football's highest individual honor the Heisman trophy, caused a sensation when it was revealed earlier this month on news website Deadspin.com.

Tuiasosopo says he played the part over the phone of Lennay Kekua, the fictitious woman who was Te'o's girlfriend in the hoax. Te'o, 22, had spoken about the woman in media interviews, and reports described her surviving a car accident and then dying of leukemia in September.

Te'o has said since the hoax was exposed that he was the victim of an elaborate prank, that he never met Kekua and that his acquaintance Tuiasosopo admitted to him that he was the one who played the part of Lennay.

Dr. Phil said in a segment on "Today" on Wednesday that after an extensive interview with Tuiasosopo, he believes Te'o had no role in creating the hoax.

"Absolutely, unequivocally, no," McGraw said, in pinning the blame for the scheme on Tuiasosopo.

The NBC morning program also showed some comments Tuiasosopo made in his interview for the "Dr. Phil" daytime program.

"There are many times where Manti and Lennay had broken up," Tuiasosopo told "Dr. Phil."

"But something would bring them back together, whether it was something going on in his life or in Lennay's life, in this case in my life," Tuiasosopo said.

Tuiasosopo, 22, is from southern California and played high school football in 2005 at Antelope Valley High north of Los Angeles, according to media reports. Tuaisosopo's attorney had previously told reporters his client was behind the hoax.

Before the hoax was exposed, a photo of a woman who was described as Lennay Kekua was presented in media reports about Te'o and his struggles to overcome her death and that of his grandmother, who actually did pass away.

But the photo of Kekua was taken from a Facebook profile of a California woman who said she was unaware of the scheme, according to Deadspin.com.

Te'o told Katie Couric in a broadcast of her show "Katie" last week that he received a telephone call from the person claiming to be Kekua on December 6 - two days before the Heisman presentation. But he said he was not really certain she never existed until Tuiasosopo's later confession to him.

The linebacker, during the Katie Couric interview, presented a voice mail he received from the person he said he thought was Kekua. "Doesn't that sound like a girl?" Te'o told Couric.

Te'o also told Couric he is not gay. "No, far from it," he said.

Next generation solar cells: Trapping sunlight with microbeads

Jan. 29, 2013 ? In five to seven years, solar cells will have become much cheaper and only one-twentieth as thick as current solar cells. The trick is to deceive the sunlight with microbeads.

Nanoscientists are currently developing the next generation of solar cells, which will be twenty times thinner than current solar cells.

Over 90 per cent of the current electricity generated by solar panels is made by silicon plates that are 200 micrometres thick. Several billion of these are produced every year. The problem is the large consumption of silicon: five grams per watt.

200 Alta power stations: This year, between five and ten billion solar panel units will be produced worldwide. This is the equivalent of 30 GW, or the capacity of 200 Alta power stations.

Though silicon is one of the most common elements on earth, pure silicon does not exist in nature. Silicon binds readily to other elements. In order for solar cells to function, the silicon plate must consist of at minimum 99,9999 per cent silicon. You read that right: if the solar cell consists of more than one millionth other materials, it does not work.

Today, pure silicon is created in smelters at 2,000 degrees Celsius. This requires a lot of energy. Factories supply silicon in bricks the size of a piece of firewood. They are then cut into slices thin enough for solar panels. Only half become solar cells. The rest turns into sawdust.

"About 100,000 tonnes of silicon are consumed every year. However, there is obviously something fundamentally wrong when half of the silicon must be thrown away during the manufacturing process," says Erik Marstein. He is the Head of the Norwegian Research Centre for Solar Cell Technology, the Head of Research for the solar cell unit at the Institute for Energy Technology (IFE) at Kjeller outside of Oslo, and an Associate Professor in the Department of Physics at the University of Oslo (UiO), Norway.

The price of solar cells is falling steadily. Today, solar panels cost a half Euro for every watt. Only four years ago, the price was two Euros per watt.

"It is difficult to make money producing solar cells at current prices. To make money, solar cells must be manufactured much more cheaply."

Super-thin solar cells in 2020

Together with Professor Aasmund Sudb? in the Department of Physics, Erik Marstein is at the forefront of the development of the next generation of solar cells. They can come on the market in five to seven years.

"The most obvious way ahead is to make very thin solar cell slices, without increasing costs."

This general rule applies to all types of solar cells: the more electrons sunlight pushes out, the more electricity. And the more energy in the electrons, the higher the voltage.

"The thinner the solar cells become, the easier it is to extract the electricity. In principle, there will therefore be a higher voltage and more electricity in thinner cells. We are now developing solar cells that are at least as good as the current ones, but that can be made with just one twentieth of the silicon. This means that the consumption of silicon can be reduced by 95 per cent," says Erik Marstein to the research magazine Apollon at University of Oslo.

However, there is a big but! The thinner the plates, the less sunlight is trapped. This has to do with the wavelengths of light. Blue light has a much shorter wavelength than red light. Blue light can be trapped by plates that are only a few micrometres thick. In order to trap the red light, the silicon plate must be almost one millimetre thick. For infrared light, the plate must be even thicker.

When the solar cell plate is to be as thin as 20 micrometres, too much of the light will go straight through.

The thickness of current solar cells is doubled by a mirror. By reflecting the light, the passage of the light through the plate is doubled.

A 20 micrometre think solar cell with a mirror will in theory be 40 micrometres thick. However, that is not enough. Furthermore, the current mirrors are far from perfect: they only reflect 70 to 80 per cent of the light.

The magic

"This is where the magic comes in. We are trying every possible wonderful trick with light. Our trick is to deceive the sunlight into staying longer in the solar cell"

This extends the duration of the sunlight's passage within the solar cell," explains Erik Marstein. This is called light harvesting.

His research group is now making a back sheet peppered with periodic structures, to be able to decide exactly where the light should go. They have managed to force the light to move sideways.

"We can increase the apparent thickness 25 times by forcing the light up and down all the time. We have calculated what this back sheet must look like and are currently studying which structures work."

One of the options is to cover the entire back sheet with Uglestad microbeads, which is one of the greatest Norwegian inventions of the previous century. Uglestad microbeads are very small plastic spheres. Each sphere is exactly the same size.

"We can force the Uglestad microbeads to lie close together on the silicon surface, in an almost perfect periodic pattern. Laboratory trials have shown that the microbeads can be used as a mask." Doctoral Research Fellow Jostein Thorstensen shows that lasers are well-suited to etch indentations around the microbeads.

"We are now investigating whether this and other methods can be scaled up for industrial production. We have great faith in this, and are currently in discussions with multiple industrial partners, but we cannot yet say who."

Asymmetrical tricks

To trap even more light in the solar cell, Jo Gjessing has completed a doctorate on how to make asymmetrical micro indentations on the back of the silicon slice.

"Cylinders, cones and hemispheres are symmetrical shapes. We have proposed a number of structures that break the symmetry. Our calculations show that asymmetrical microindentations can trap even more of the sunlight," says his supervisor, Erik Marstein.

In practice, this means that 20 micrometre solar cells with symmetrical micro indentations are as effective as 16 micrometre plates with asymmetrical indentations. This means that silicone consumption can be reduced by another 20 per cent.

"Our main goal has been to get the same amount of electricity from thinner cells. We will be very satisfied even if our new solar cells are 30 micrometres," notes Professor Aasmund Sudb?.

The new solar cells are produced in different ways, for instance by splitting the thin silicone foil or growing thin silicon films. And the extra bonus? Silicon wastage is minimal.

Syria says Israel bombed a facility near Damascus

BEIRUTIsrael conducted a rare airstrike on a military target inside Syria, foreign officials and Syrian state TV said Wednesday, amid fears President Bashar Assad's regime is providing weapons to the Islamic militant group Hezbollah.

A statement from the Syrian military read aloud on state TV confirmed the strike, saying the jets bombed a military research center in the area of Jamraya, northwest of the capital, Damascus.

The statement said the center was responsible for "raising the level of resistance and self-defense" of Syria's military. It said the strike destroyed the center and a nearby building, killing two workers and wounding five others.

"The fighter jets of the Israeli enemy sneaked from the south of the Golan Heights below the radar and attacked the research," the statement said.

But CBS News' David Martin at the Pentagon says Israel hit a convoy believed to be carrying weapons to Hezbollah, the militant group based in Lebanaon.

Regional security officials said Israel had been planning in the days leading up to the airstrike to hit a shipment of weapons bound for Hezbollah, Lebanon's most powerful military force and a sworn enemy of the Jewish state. Among Israeli officials' chief fears is that Assad will pass chemical weapons or sophisticated anti-aircraft missiles to Hezbollah ? something that could change the balance of power in the region and greatly hinder Israel's ability to conduct air sorties in Lebanon.

The regional officials said the shipment Israel was planning to strike included Russian-made SA-17 anti-aircraft missiles, which would be strategically "game-changing" in the hands of Hezbollah by enabling the group to carry out fiercer attacks on Israel and shoot down Israeli jets, helicopters and surveillance drones.

Hezbollah has committed to Israel's destruction and has gone to war against the Jewish state in the past.

A U.S. official confirmed the strike, saying it hit a convoy of trucks. All officials spoke on condition of anonymity because they were not authorized to discuss the strike.

Syria has long been among the militant group's most significant backers and is suspected of supplying with funding and arms, as well as a land corridor to Iran.

This strike, however, comes as Assad is enmeshed in a civil war with rebels trying to oust him. The rebels have seized a large swath of territory in the country's north and established footholds in a number of suburbs of the Syrian capital, Damascus, though Assad's forces still control the city and much of the rest of the country.

While Assad's fall does not appear imminent, analysts worry he could grow desperate as his power wanes and seek to cause trouble elsewhere in the region through proxy groups like Hezbollah.

The Syrian army statement denied that the strike had targeted a convoy headed from Syria to Lebanon, instead portraying the strike as linked to the civil war pitting Assad's forces against rebels seeking to push him from power.

"This proves that Israel is the instigator, beneficiary and sometimes executor of the terrorist acts targeting Syria and its people," the statement said.

The location could not be independently confirmed because of reporting restrictions in Syria.

Syria's government portrays the crisis, which started with political protest in 2011 and has since become a civil war, as a foreign-backed conspiracy meant to destroy the country.

Top Israeli officials have recently expressed worries that if desperate, Assad's regime could pass chemical weapons to Hezbollah or other militant groups.

Study finds improvement in German consumer mood

BERLIN (AP) ? A closely-watched survey shows German consumers are more optimistic, buoyed by the current calm in financial markets and expectations the economy will gradually revive over the course of the year.

The GfK institute reported Tuesday that its forward-looking indicator rose to 5.8 points for January, up from a revised 5.7 in January.

Analyst Carsten Brzeski says the indicator is "another small piece of evidence that domestic demand should be an important growth driver in 2013."

The report shows overall economic expectations still in negative territory, at minus 11.3 in January ? but that was an improvement from December's minus 17.9.

Income expectations rose to 36 in January from 21.2 in December, while consumers' willingness to buy was up to 35.3 from 20.1.

The report is based on 2,000 consumer interviews.

Another rhesus monkey named Albert II, for example, became the first primate to reach space, achieving an altitude of 83 miles aboard another V2 in June 1949. He survived the launch but died after a parachute failure caused his capsule to slam hard into the ground.

Alberts III and IV died during their missions in late 1949, and Albert V was victimized by another parachute failure in 1951. Albert VI, also known as Yorick, survived his 1951 flight, though it topped out at an altitude of just 45 miles ? significantly below the generally accepted 62-mile boundary demarcating outer space.

Yorick died several hours after landing, possibly from heat stress suffered as he sat inside his cramped capsule in the New Mexico sun, waiting for the recovery crew.

The United States recorded a milestone in May 1959, finally recovering two primates alive after a spaceflight. A rhesus monkey named Able and a squirrel monkey named Baker reached an altitude of 300 miles aboard a Jupiter rocket and were retrieved unharmed. (Sadly, Able died several days later during an operation to remove an electrode from under her skin.)

As the American human spaceflight program began to build momentum, the nation started experimenting with chimpanzees, which are larger and more closely related to humans than are rhesus, squirrel or other monkeys.

The U.S. launched a chimp named Ham on a suborbital spaceflight on Jan. 31, 1961. Ham reached an altitude of 157 miles during a 16.5-minute flight and was recovered unharmed, though a bit dehydrated. With this success in hand, Alan Shepard successfully blasted off on his suborbital flight on May 5, 1961, becoming the first American ? and second human, after the Soviet Union's Yuri Gagarin ? ever to reach space.

A chimp named Enos orbited the Earth on Nov. 29, 1961, paving the way for John Glenn's historic orbital flight of Feb. 20, 1962. (Again, the U.S. was slightly late to the party: Gagarin orbited our planet on his flight of April 12, 1961.)

After it became established that humans could indeed survive the rigors of spaceflight, monkeys and apes faded into the background. The U.S. continued to launch animals for scientific experiments but increasingly concentrated on smaller creatures such as mice and insects, which are easier to care for and take up much less space (although two squirrel monkeys did ride on the space shuttle Challenger 's STS-51-B mission in April-May 1985.)

The United States' space race rival, the Soviet Union, primarily used dogs in the run-up to its first human launches, thinking that canines would prove to be less fidgety in flight than monkeys.

The Soviets launched their first dogs to space in 1951. The nation famously succeeded in lofting the first animal ? a dog called Laika ("Barker") ? to orbit aboard the Sputnik 2 spacecraft in November 1957. (Laika died during the flight.)

Despite its canine focus, the Soviet Union and its successor state Russia did launch a number of rhesus monkeys to space in the 1980s and 1990s, as part of a program called Bion. France also blasted two pig-tailed macaque monkeys to suborbital space in 1967.

Iran's recent launch was not its first attempt to send a monkey into space. A previous orbital effort in 2011 failed.

At Downsize Fitness gyms, the slender need not apply

NEW YORK (Reuters) - At Downsize Fitness health clubs, the treadmills are wider, the head trainers are weight-loss veterans and new members must be at least 50 pounds (22.7 kgs) overweight.

It's all about creating a more welcoming environment to battle the bulge and drop the excess weight.

Francis Wisniewski, a hedge fund manager, started Downsize Fitness in 2011, when he was struggling to lose weight and found himself intimidated by one-size-fits-all gyms.

"I figured if I was uncomfortable, a lot of people must be. Overweight people feel like they're on display," said Wisniewski, who has gyms in Dallas and Chicago.

His inspiration came from the hit television reality show "The Biggest Loser."

"We wanted to make it the ?Biggest Loser' in real life," he said. "Most people would be successful if they could spend 15 weeks just exercising. In real life we have jobs. You go to the gym one hour, five times a week and change your diet."

The gym provides nutritional counseling, and the equipment is built for heavier people.

"A lot of equipment supports only up to 350 pounds," he said. "Ours is over 600. And our personal trainers are used to working with overweight people. Two of our head trainers have lost over 100 pounds on their own."

Wisniewski said people can lose 50 pounds in six-to-12 months of training.

"We didn't want people who need to drop 20 pounds for a wedding," he added.

Comfort and camaraderie are what matter to Dave Chiscon, a 38-year-old Chicagoan who joined Downsize Fitness in late August.

"I walked in and people my size were really working out hard," said Chiscon. "We're all in the same boat. We're all moving in the same direction."

Chiscon, who has lost 30 pounds in four months, said the gym is the highlight of his day.

"I work hard and I burn 1,200 calories," he said.

Along with his cardio and resistance routines, he's become a fan of group fitness classes, such as yoga, Pilates and boot camp.

"At other gyms, if I'm doing jumping jacks and my belly flops out of my shirt, I would stop," he said. "At this gym I don't care. The woman next to me is doing the same thing."

Gary Liguori, an expert in exercise science with the American College of Sports Medicine, called Downsize Fitness a unique behavioral approach for getting people active because they don't have to worry about being self-conscious.

He said historically overweight people have not been successful with exercise and it's not unusual for them to feel intimidated at gyms.

Test for hormone-disrupting chemicals gets global seal of approval

Jan. 29, 2013 ? A test for hormone-disrupting pollutants, originally developed at the University of California, Davis, has been approved as an international standard by the Organization of Economic Cooperation and Development as well as by the U.S. government.

"Endocrine disruptors" are chemicals that interfere with the action of hormones on cells. There has been growing concern that such chemicals, from a wide variety of products, might have an impact on both human health and the environment.

Hormones such as estrogen act on cells by triggering a receptor on the cell surface, setting off a chain of events inside the cell. The new test uses a cell line, BG1Luc4e2, which produces a glowing firefly protein called luciferase when exposed to estrogens or similar chemicals.

The test was originally created by Professor Michael Denison and colleagues at the UC Davis Department of Environmental Toxicology. It has been validated by the National Toxicology Program at the U.S. Department of Health and Human Services and by the U.S. Environmental Protection Agency, and now by the OECD.

The test is licensed to users through UC Davis, in collaboration with UC San Diego and Promega, Inc. of Madison, Wisc., and which own patents on some components of the test. Typical customers are companies that carry out environmental testing for clients.

White House praises Senate immigration plan

WASHINGTON (AP) ? The White House is praising an agreement on immigration reform reached by senators from both parties, calling it an important first step.

Details about the Senate plan are still sketchy, but White House spokesman Jay Carney says it embodies the same principles President Barack Obama believes are necessary.

A bipartisan group of leading senators is announcing their plan Monday for a sweeping overhaul, including a path to citizenship for about 11 million illegal immigrants. The plan also includes border security, a guest worker system and employer verification.

Obama will travel on Tuesday to Nevada to lay out his vision, which is expected to overlap with the Senate effort.

Illinois Governor Pat Quinn signed a bill into law today that grants hundreds of thousands of?undocumented?immigrants the right to drive. The new law makes Illinois the fourth state to allow driver?s licenses or permits for undocumented immigrants and comes ahead of President Obama?s ?expected announcement on a plan for?comprehensive immigration reform expected on Tuesday.

Quinn and the?bipartisan supporters of the legislation say the measure will improve traffic safety in the state. ?This common sense law will help everybody, regardless of their background, learn the rules of the road, pass a driving test and get insurance,??Governor Quinn said. Despite the stalemate on immigration reform in Washington D.C., Illinois is moving forward. As a result, our roads will be safer, we will create more access to job opportunities and our economic growth will be strengthened.?

For Illinois residents such as Eugenia Flores, a 41-year-old undocumented immigrant from Mexico, the new law could provide protection from criminal prosecution.?Currently, if undocumented immigrants decide to get behind the wheel, a routine traffic stop could lead to fingerprinting and possible?deportation.

?I?m a good driver,? says Flores. ?But my kids get scared when the police stop me. They don?t want me to drive anymore. But I tell them I have to because who will take them to school??

Proponents of the controversial?law, including Chicago Mayor Rahm Emanuel, count about 250,000 undocumented immigrants in the state who drive without licenses. These untrained and untested drivers lead to crashes and higher insurance costs for other motorists, with unlicensed immigrant drivers accounting for around $64 million in damage claims every year, according to the Illinois Highway Safety Coalition.

Unlicensed drivers will continue to drive with or without a license says Lawrence Benito, president of one of the chief?lobbying groups for the bill, the Illinois Coalition for Immigrant and Refugee Rights. ?They have to continue to bring their kids to school or go to church or drive to work,? he says.

The issue has divided lawmakers in Washington, Utah and New Mexico, the only three states that provide identification for undocumented immigrants who wish to drive. The debate has picked up momentum ahead?of federal legislation?that will soon require state driver?s licenses to double as national identification.?Opponents of the measure, including?Governor Susana Martinez of New Mexico,?cite concerns that these types of licenses?will lead to fraud.

In November 2011, two road test instructors?for the Ilinois Secretary of State were indicted for accepting money in exchange for fake driver?s licenses as part of a crime ring.

Meanwhile, Illinois Representative Dwight Kay argues that the law will lead to an influx of undocumented immigrants to the state.

?Granting individuals who came to our country illegally and giving them a benefit sends the wrong message,? Kay said in a statement after the Illinois House passed the legislation. ?A driver?s license is a privilege, not a right; giving illegals the privilege to drive in our state legally when they broke our laws to come here is bad public policy. We must follow our Constitution and not pass laws based on whichever way the wind blows.?

Applicants for the license must provide a form of identification such as a passport, as well as proof of Illinois residency. ?License holders won?t be able to purchase firearms, fly on commercial planes or vote ? the card can only be used for driving. But, for Eugenia Flores, that privilege is more than enough.

?I don?t want to spend my life just inside my house,??says Flores. ?When the police stop you, you feel like a criminal. Now, I can feel free.?

Government rules U.S. schools must provide sports to disabled

(Reuters) - U.S. schools must give disabled students the chance to compete in extracurricular sports alongside their able-bodied classmates, or else provide them with their own programs, the federal government said in new guidelines issued on Friday.

The Education Department issued the directives to clarify schools' legal obligations to their disabled students, and to urge school districts to work with community organizations to "increase athletic opportunities" for them.

"Participation in extracurricular athletics can be a critical part of a student's overall educational experience," said Seth Galanter, of the department's civil rights office. "Schools must ensure equal access to that rewarding experience for students with disabilities," he added.

The 1973 Rehabilitation Act prohibits discrimination on the basis of disability in programs conducted by federal agencies, including public education.

The directive followed a critical report by the Government Accountability Office that found disabled students were not being given the same chance to take part in school sports, and recommended that the department clarify and communicate to schools their responsibilities.

Examples of reasonable modifications schools might make to meet their responsibilities included providing "visual clues" alongside a starter pistol to allow hearing disabled students to compete in track events, and waiving the "two-hand touch" finish at swim meets to allow one-armed swimmers to compete.

The new directive was seen by advocates for the disabled as on a par with the 1972 "Title IX" rule that forced schools to provide equal athletic opportunities to girls.

It was also welcomed by disabled student competitors, among them Casey Followay, a 15-year-old high school track athlete confined to a wheelchair by a birth defect, who under current rules, has to race on his own.

"This will help me become a better athlete conditioning- wise, because I have something to push for," said Followay, who filed a complaint with the U.S. Office of Civil Rights in 2011 asking that he be allowed to run alongside, but not against, the able-bodied.

But some detractors saw the directive as an overreach by the department that could potentially place additional cost burdens on schools at a time of constrained budgets.

"This is just a straight-up unfunded mandate ... Americans support giving equal opportunities. We need to have some deliberation on the extent," said Michael Petrilli, executive vice president at the Thomas B. Fordham Institute, a Washington, D.C.-based think tank.

"The problem is this was done without any deliberation in Congress and no public input and it is not clear how expansive it will be. Just how far must a school district go to be compliant?"

Toronto Mayor Ford Keeps Job, But Far from Vindicated ? The ...

Toronto mayor Rob Ford will apparently be keeping his job. An appeals court has overturned a previous court decision that had said that Ford had violated the province?s conflict of interest law.

The decision came down today from the Divisional Court which heard Ford?s appeal of his November conviction. The panel of three judges has now concluded that the original trial judge had made an error in finding Ford guilty under the Municipal Conflict of Interest Act.

Many Torontonians were bewildered by the original verdict, and by the fact that it could result (as required by the Act) in Ford?s removal from office and a multi-million dollar by-election. Ford?s offence, after all, was hardly armed robbery. He was merely accused of participating in a city council vote on a relatively small financial matter. The question under consideration at that vote was whether he, Ford, should return a few thousand dollars? worth of donations that the city?s integrity commissioner says were improperly gathered. So it?s not as if Ford had stolen the money, or embezzled it. And garnering the donations was not itself a legal offence. The problem lay solely in his having voted on this matter, a matter in which he had a personal stake. Many people wondered how it could be that Toronto could lose its duly elected mayor over such a small procedural matter.

But bewilderment about that initial verdict says more about public understanding of conflict of interest than it does about the substance of this case. Conflict of interest isn?t about numbers; it?s about loyalty. And when we think someone has violated a conflict of interest rule it?s not necessarily because we think he or she has made an improper decision, but rather that we think he or she has failed to keep personal business and official duties separate, and that as a result we cannot be sure about what factors may have influenced that decision. It is also, in the end, about public faith in the decision-making processes of our most important institutions.

Be that as it may, today?s decision means that Ford is not guilty of violating the Act, and hence gets to keep his job. My non-lawyer?s understanding of the verdict is this. The decision seems to turn on a technicality. Ford had been accused of wrongfully participating in a February 2012 debate and vote by Toronto city council over whether he, Ford, should return the improperly-gathered donations. A council vote 2 years earlier had required Ford to pay back that money. But, according to today?s ruling, Council didn?t have the authority to engage in that earlier vote. So it was legally null ? effectively, it never happened at all, from a legal point of view. And if the earlier vote ?didn?t happen,? then the February 2012 vote that essentially responded to that earlier vote was really moot. And if that vote was moot, it cannot have been improper for Ford to participate.

But the court?s decision today is far from a vindication. Ford keeps his job on a legal technicality, the sort of thing that a layperson could never foresee from a reading of the plain wording of the relatively brief and clear Municipal Conflict of Interest Act.

That?s fair enough, from a procedural point of view, but it doesn?t mean that the mayor didn?t do anything wrong. He still took part in a decision in which he had a personal stake. And as a man in a position of power and trust, he not only should not have done so, but he should have known better than to do so. Even if he knew in his heart that his vote in the matter was unbiased, he should have known that that?s beside the point. What matters is that trust in the system requires decision makers to remove themselves from decisions that pertain to their own affairs. Doing so is essential for maintaining public trust in the system.

We can only hope that Ford will proceed now with uncharacteristic humility, and with more eagerness to learn the rules that govern his position than he has thus far demonstrated.
