Documents required for a secure real estate transaction

It pays to be cautious; especially when dealing with murky state of affairs pertaining to real estate transactions. No amount of scrutiny would suffice while purchasing a property. Due to the existing state of affairs, especially in the absence of a regulator or a real estate bill there is always a confusion when it comes to documents regarding the property.

The following are the documents that should be checked and thoroughly inspected before and even after buying/selling a property:

?

Written agreement

A written agreement should be imperatively provided by the developer. The agreement should acutely mention the all the terms and conditions, specifications of the apartment, time of delivery and the payment plan.?The agreement should additionally mention the exact quantum of penalty to be imposed in the event wherein the developer fails to meet the construction deadline as well as in the event wherein the buyer defaults on the payment schedule.

In the case of buying a house within a completed project, the occupation certificate, electricity and water connections, fire safety equipment and mechanism and property tax receipts for the project should be physically checked by the buyer. In particular, the occupation certificate issued by a government authority is very substantial.

Employing the services of a bank:

Buying a flat through a bank loan is the best course of action. Since the bank accepts the apartment which is yet to be constructed in a new project, as collateral, they do all the checks, including the builder?s credentials, to ensure that the collateral?s market value does not diminish.

Buyer-seller agreement:

This agreement includes each and every clause, conditions, terms and legal implications for the buyer and developer should there be a default on either side. Prominent points are interest, default charges for a buyer, penalty and clauses of refund of payment in case the project is not completed or is scrapped.

Also, the penalty in case of any structural defects or delay in construction as well as a clause to transfer the common undivided land to the society and owners to ensure that further construction or development cannot be undertaken by the developer once the completed project is handed over, should be included within a registered agreement.

Documents:

For Delhi:

Perpetual lease deed, Conveyance deed, Sale deed in case of resale properties, Mutation paid, Last paid house tax receipt, Last paid electricity and water bills, Completion certificate and Sanctioned plans.

For Noida/Greater Noida:

Allotment letter from Noida Authority (in case of a plot or flat built by authority), Registered perpetual lease deed, Proof of payment of lease rental, one-time or yearly; Transfer memorandum and registered transfer deed in case of resale property, NOC from Jal Department, Share certificate and NOC from society (where applicable as some old sectors or group housings have been allotted to societies), Completion certificate for houses with sanctioned building plans and Mutation letter in name of current owner.

For Gurgaon:

Allotment letter (in case of either HUDA or DLF properties ? builder-buyer agreement), Registered sale deed in name of current owner with all originals from previous owners, Sanctioned building plans and completion certificate in case of independent houses, Mutation letter from DLF or HUDA, Proof of up-to-date payments of power and water and house tax charges, NOC from RWA or maintenance office in case of group housing.

Titles and documentation:

In case the property is purchased from the urban development authorities, the risk of clear titles and documentation decreases by a significant margin.

Howbeit, one should seek legal assistance to check documents related to land ownership, allotment letter, licences and approvals, sanctioned plans etc, if the flat is being purchased either from a colonizer or private developer.

Certificates:

Certificate from society:

The share certificate issued by a society should be checked by the buyer, as it establishes the seller?s identity. The share needs to be transferred in the name of the purchaser. This certificate forms a part of the ownership deed.

NOC from society:

In case of a resale, the no objection certificate (NOC) which is issued by the society should be verified. This NOC states that dues payable by the seller to the society are nil and that the conditions laid down by the society have been complied by the seller.

Ownership titles for group housing cooperatives:

Essentially, the ownership documents allotted or the shares transferred should be verified to ascertain the legal rights.

Title papers:

In case the property is being purchased directly from a builder, the title papers should be checked as it proves the owner?s identification. The document can also be used to determine whether property has a clear title or if its under litigation, whether the seller possesses the authority to develop or sell the property, whether the land is on leasehold or freehold as well as indicate whether the property is free of encumbrances. If there is a conveyance deed favoring the seller, then it ensures that the property has a clear title.

Checking by bank:

If the property is being purchased through a bank loan, the bank would normally appoint its own lawyer to verify the title deeds. Or, a lawyer can be hired and a request for originals can be placed with the bank. In any case photocopies of the documents should not be accepted.

Municipal clearances:

The completion certificate which is issued by the municipal authorities is another important document. It proves whether a building is in compliance with the rules and regulations in respect of distance from road, height, besides other things. The occupation certificate should also be verified as it certifies that the electrical connections, sewage and water are in place.

Development agreement:

In case the property has been constructed jointly by the builder and the owner, the joint development agreement which mentions the terms of development of the property.should be scrutinized.


Purchase agreement:

The purchase agreement between the developer and the authority or the agency from which the developer has bought the land too needs to be scrutinized. It ensures the seller (builder) has the authority to sell the property, and it also states if the property has any mortgages against it.

List of approvals:

Noncompliance in getting legal approvals from a number of authorities may result in scrapping of the project or reduction in the market value. The approvals to be obtained are structural safety certificate, building plans and floor plan approvals, no-objection certificate from the civic authority, urban land ceiling certificate, environment clearances, commencement certificate and title deed. The buyer upon possession, should physically check the occupation certificate, water and electricity connections, fire safety equipment and mechanisms and property tax receipts.

San Diego Mayor Bob Filner is asking the city to pay his legal expenses for a sexual harassment lawsuit filed by his former communications director. Filner?s lawyer sent a letter to the city, imploring it to cover the mayor?s legal bills in a lawsuit that accuses him of asking his former female aide ?to work without panties? and other alleged acts of sexual harassment.

City council members?who overwhelmingly want Filner to resign?are scheduled to convene Tuesday night for a special closed session to consider the mayor?s request.

Under California law, Filner is allowed to set up his own legal defense fund in the case the city rejects his request. Filner?s lawyer,?Harvey Berger, argues that his client should be defended under the city?s expense. The letter states that Filner should have the city pay for representation under California government codes?825?and?995?? which deal with compensation and defense of public employees.

Since the claim was first filed by Filner?s former employee Irene Jackson,?seven women have publicly come forward and detailed other alleged acts of sexual harassment, including touching and kissing. Jackson, who is represented by high-profile attorney Gloria Allred, was the first woman to publicly accuse?Filner of harassment. In her 11-page lawsuit, Jackson claimed Filner demanded kisses and told her he wanted to see her naked.

The mayor, who is 70 and divorced, has since apologized for ?offending? women. On Friday, Filner announced that he would enter two weeks of ?intensive? therapy starting Aug. 5 to ?begin the process of addressing [his] behavior.?

Filner?s own party leaders, including California Sen. Dianne Feinstein and?House Minority Leader Nancy Pelosi,?have urged him to resign.??The conduct of some of these people that we?re talking about here is reprehensible,? said Pelosi last week about both the Filner and Anthony Weiner scandals. ?It is so disrespectful of women, and what?s really stunning about it is they don?t even realize. They don?t have a clue.?

Feinstein directly called for the mayor?s resignation and predicted a recall election for the mayor?s seat. ?It?s a very tough job, and I don?t think that somebody who is lacking a moral compass really sets a role model or really will provide the kind of leadership that San Diegans want.??Feinstein said on Sunday.

Microsoft revealed early Monday the prices for two of the key accessories for the upcoming next-generation Xbox One video game console ? the standalone controller, which will cost $59.99, and an official Xbox-branded wireless headset to support the consoles various chat and voice features for an additional $24.99. Like most video game hardware, the starting bundle that Xbox One owners receive will include a single controller, and Microsoft has said that the new device will not be compatible with current-generation Xbox 360 controllers.

For a point of comparison, Sony's upcoming PlayStation 4 console ? which at a starting price of $399.99 will debut for $100 less than the Xbox One ? comes bundled with an earbud-style headset but will only offer its motion-controlled camera peripheral, the imaginatively named PlayStation Camera, for an extra $59.99. Unlike the Xbox One's Kinect hardware, the PlayStation Camera is not a mandatory feature for the PlayStation 4 console. Additional PS4 controllers also cost $59.99, and the console is not backwards compatible with older versions of the PlayStation DualShock controller.

Regardless of whether or not a headset is contained in the starting console package, however, that most serious gamers will likely look to make a heftier investment in a high-end gaming headset like those offered by Turtle Beach, Tritton, or Astro if they're actually planning to use either console's chat capabilities for actual gameplay purposes. According to a report from the video game site Polygon, Sony has confirmed that the PlayStation 4 will be compatible with the same headgear that currently befits the PlayStation 3. Microsoft, meanwhile, has been vague on whether or not gamers will be able to use their current headsets, which can run upwards of $200 for the best models, on the next-gen hardware.

LONDON (AP) ? Usain Bolt has a new challenger, and maybe even a new distance to think about.

The biggest star in track is being sought out by Mo Farah for a charity race somewhere between Bolt's sprint specialty and Farah's distance domain.

"It'd be great to be able to do a distance where people vote in what distance will be suitable, and then get a judge and then come in the middle with that distance and train for it," said Britain's Farah, who won the 5,000 and 10,000 meters at last year's London's Olympics. "Bolt, are you up for that? Come on, you got to do it."

Bolt has little left to prove on the track. The Jamaican won the 100 and 200 in world-record time at the 2008 Beijing Games, and then became the first man to defend those titles at last year's Olympics. He also helped Jamaica win the 4x100 relays at both.

On Friday in London, Bolt won the 100 meters at the Anniversary Games, a Diamond League meet that took place in the Olympic Stadium to mark one year since the start of the 2012 Olympics. Farah won the 3,000 on Saturday.

Despite the differences in distances, Bolt seems to be considering Farah's challenge.

"That sounds fun. It's going to be hard, but for me it's charity, so it's just all about fun and enjoyment," Bolt said. "For me, I'm up for anything if it's possible."

The hard part would be deciding what distance to race.

Bolt may be the best sprinter of all time and has run the 400 before. Farah, however, is a distance specialist who is talking more and more about moving in the other direction and adding the marathon to his running regime.

So even one of the middle distances, such as the 1,500 meters, would seem unlikely.

"Way too far," Bolt said. "(The) 600, for sure, I can try, because I've done 600 in training."

Two running stars meeting at a made-up distance is not new. Nearly a year after the 1996 Olympics, 200-400 gold medalist Michael Johnson and 100 champion Donovan Bailey met in a much-hyped 150-meter race in Toronto.

About halfway through, Johnson pulled up with a muscle injury in his left thigh, leaving Bailey to win $1 million.

Wave of car bombings in Iraq kills at least 47

(AP) ? A wave of over a dozen car bombings hit central and southern Iraq during morning rush hour on Monday, officials said, killing at least 47 people in the latest coordinated attack by insurgents determined to undermine the government.

The blasts, which wounded scores more, are part of a months-long surge of attacks that is reviving fears of a return to the widespread sectarian bloodshed that pushed the country to the brink of civil war after the 2003 U.S.-led invasion. Suicide attacks, car bombings and other violence have killed more than 3,000 people since April, including more than 500 since the start of July, according to an Associated Press count.

There was no immediate claim of responsibility for Monday's attacks, but they bore the hallmarks of al-Qaida's Iraqi arm. The group, known as the Islamic State of Iraq, frequently sets off such coordinated blasts in an effort to break Iraqis' confidence in the Shiite-led government.

Eight police officers said a total of 12 parked car bombs hit markets and parking lots in predominantly Shiite neighborhoods of Baghdad within one hour. They say the deadliest was in the eastern Shiite neighborhood of Sadr City, where two separate explosions killed nine civilians and wounded 33 others.

Ambulances rushed to the scene where rescuers and police were removing the charred and twisted remains of the car bombs from the bloodstained pavement. The force of the two explosions lightly damaged nearby houses and shops.

Two other separate car bombs went off in the northern Hurriyah neighborhood, killing six bystanders and wounding 23 others. In the busy northern Kazimiyah neighborhood, another parked car bomb killed four civilians and wounded 12.

In the southwestern neighborhood of Bayaa, three civilians were killed and 15 wounded in another car bomb explosion. In western Baghdad in the neighborhood of Shurta, two other people were killed and 14 wounded.

In the southern Abu Disheer area, four civilians were killed and 17 wounded. Another car bomb struck in the northwestern Tobchi district, killing three and wounding ten others.

Five more people were killed and 44 others wounded in the southwestern Risala neighborhood, the northern Shaab neighborhood and in the town of Mahmoudiya, about 30 kilometers (20 miles) south of Baghdad.

The wave of bombings also extended to Iraq's majority-Shiite south.

Back-to-back explosions by two parked car bombs in an outdoor market and near a gathering of construction workers killed seven civilians and wounded 35 others in the city of Kut, 160 kilometers (100 miles) southeast of Baghdad.

And in the oil-rich city of Basra in southern Iraq, four other people were killed and five wounded when a parked car bomb ripped through a market. Basra is 550 kilometers (340 miles) southeast of Baghdad.

Nine health officials confirmed the casualty figures. All officials spoke on condition of anonymity as they were not authorized to release information.

The violence surged after an April crackdown by security forces on a Sunni protest camp in the northern town of Hawija that killed 44 civilians and a member of the security forces, according to United Nations estimates. The bloodshed is linked to rising sectarian divisions between Iraq's Sunni and Shiite as well as friction between Arabs and Kurds, dampening hopes for a return to normalcy nearly two years after U.S. forces withdrew from the country.

Food For The Week: What Families Across The Globe Are Bringing ...

Faith D?Aluisio and Peter Menzel have successful careers documenting diet, economic and environmental habits of the World. They have a knack for juxtaposing stories to help individuals understand their habits in comparison to those of other time zones and means.

The pair have co-created several books and I think each project is successful because of their teamwork in the field. Peter, a photographer well known for his coverage of ?science and technology, and Faith, a former TV news producer and ?talented writer, are a husband and wife power team.

In 2008, they put together a photo album of families from 21 countries. Each portrait is full color and beautifully presents one family with their weekly food supplies. With each image the authors noted the expenditures, the family?s favorite foods, brand names and facts about the country.

D?Aluisio and Menzel have discussed the impact of their work and how they hope it adds to the discussion of nutrition education:

At the launch of the BlackBerry Z10 and Q10 -- the first hardware devices to run on the long-awaited BlackBerry 10 operating system -- there seemed to be a silver lining for the renamed company's struggling PlayBook tablet. Confirming speculation, CEO Thorsten Heins promised a cheering crowd that the PlayBook would receive an update to a new OS. This would open the door to signature features, a more polished user interface and a vastly expanded app library.

But something was amiss. The company had also announced that, to simplify app development, BlackBerry 10 would support two screen resolutions: the Z10's 1,280 x 768 and the Q10's 720 x 720. In contrast, the PlayBook resolution is 1,024 x 600. Late last month, the other shoe dropped as BlackBerry confirmed that the PlayBook would not receive the promised update, leaving it with an abandoned OS and marking the effective exit of BlackBerry from the tablet market.

India thought Jupiter and Venus were spy drones

The Indian army spent roughly six months watching and documenting what they thought were two Chinese spy drones, but were actually the planets Jupiter and Venus.

Take a dash of paranoia and add a sprinkling of incompetency and you might get something along the lines of what happened in India recently. The Indian army detected two unknown objects in the night sky sometime in August of 2012, and concluded that they were probably Chinese spy drones. The Telegraph Calcutta reports that the Indian army made 329 sightings of these objects, tracking them between August of 2012 and February of 2013. According to the army?s reports, on 155 of the sightings, the objects were in violation of the Line of Actual Control that separates China and India.

It took the Indian army six months to finally contact astronomers at the Indian Institute of Astrophysics in Bangalore to ask if they knew what the objects were. The Telegraph Calcutta writes:

The astronomers were told that the first object, viewed from a location about 4,715 metres above sea level near Thakung, appeared in the horizon at about 6pm and remained visible until about 5am. The second object appeared at 4am and faded away at 11am.

After studying the planet?s motion as well as the objects? motion in relation to the rotation of the Earth, the astronomers quickly concluded that they were looking at Jupiter (the object that appears at 6pm) and Venus (the object that appears at 4am).

This is Venus, not a spy drone.

Tensions have been high lately in the disputed border area in the Himalayan mountains between China and India. This story is comical in its stupidity, but it does hold an important lesson; jumping to conclusions can be a really bad thing. I?m sure both nations are happy this mishap didn?t escalate their dispute.

(AP) ? As Ryan Miller lay motionless on the ground, shock and then fear spread through the Browns practice.

A few players near the spot where the backup offensive lineman went down dropped to a knee in prayer. The music system was turned off. All talking stopped and an eerie quiet filled Cleveland's indoor field house.

Suddenly, a routine day at training camp was anything but.

"Anytime your brother goes down it's scary," linebacker Quentin Groves said, "because you never know. ... We're just big men that play a sport called football. But we still have hearts. We still have emotions. We still have feelings. He's our brother."

Miller sustained a concussion during a one-on-one blocking drill Saturday, an injury that shook his teammates, who were later relieved to learn that the 6-foot-7, 320-pounder had been released from the Cleveland Clinic. Until getting word that Miller had movement in his extremities and was responsive, several of the Browns were worried Miller may have suffered a devastating injury.

"It's always tough to see your fellow linemen or one of your teammates go down like that," Pro Bowl tackle Joe Thomas said. "It's hard because obviously there are things more important than football and your health is certainly one of them. Sometimes it's hard to get back and focused on football when you see a guy laying there and not moving."

Miller, who is in his second NFL season, was immobilized, strapped to a backboard and taken by ambulance to the hospital after he was hurt. He spent several hours undergoing tests before he was released.

"He's doing well," first-year coach Rob Chudzinski said following practice. "He's responsive and it sounds like things are better at this point."

The Browns were about 40 minutes into their third practice, which was moved indoors because of rain and closed to the public, when Miller got hurt. He crumpled to the field and appeared to be unconscious on his back while most of teammates, who were unaware that he had been hurt, continued to take part in drills.

Groves realized something was seriously wrong and began alerting anyone he could.

"The way he was laying down, you know it was that serious," he said.

Moments after medical personnel rushed to aid the unmoving Miller, Chudzinski came over to check on him along with linebacker D'Qwell Jackson and others. After Miller was immobilized and strapped to a backboard, the entire Browns team and coaching staff huddled around him in prayer.

"We got together," said Chudzinski, Cleveland's first-year coach. "We said a prayer, said we would keep Ryan in our thoughts and I would give them updates as we got them. We needed to get back to work at that point and focus back on practice."

It was difficult for everyone.

The Browns asked media members not to report Miller's name until his family could be contacted, raising fears he was hurt more severely. And, as Miller was being treated, the team also requested for cameras be turned off to protect his privacy.

Meanwhile, Miller's teammates were hoping for the best.

"We play this game so hard, so violent," Groves said. "Any moment, this game could be taken away, and that's the thing I want guys to learn from this. Cherish the moments while you're out here. Cherish tying your cleats up. Cherish the smell of the grass. Cherish snapping that chinstrap on because any moment it can be taken away from you."

Chudzinski did not see how Miller got hurt, but Thomas said it was the result of helmet-to-helmet contact. It was not immediately known what defensive player Miller was blocking when he went down.

"Two helmets kind of hit the wrong way," he said. "It was kind of a freak thing."

After Miller was wheeled from the building, Chudzinski huddled his players and promised to give them an update when he got one. And about an hour later he got the news that the 24-year-old was "alert and awake."

"Anytime that happens you just pray and just hope for the best and hope everything is OK," Jackson said. "Coach gave us word that he is fine and that's a good thing. But those are the challenges and the scares that when you sign up for the game there's a possibility of something like that happening. I'll tell you what, it made everyone realize that at any moment anything can happen."

Chudzinski was proud of the way his team handled the difficult event.

"I thought they did a great job," he said. "It really says a lot about them, our coaches, our staff and our players to be able to do that. This team is a family and when something happens to a family member like that, it's tough. These guys did a great job of staying focused and getting a lot of work done that we needed to get done."

Miller was drafted by the Browns in the fifth round in 2012 out of Colorado. He appeared in eight games as a rookie, and got extended time in the fourth quarter of the season finale at Pittsburgh after John Greco sustained a knee injury. He was a four-year letter winner at Colorado, setting a school record with 48 career starts. He missed just two offensive plays over his final three seasons.

Thomas, who has become close to Miller, was thrilled to hear he was doing better.

"When we heard it was not neck-related, that was fantastic news and you feel great about that," he said. "He's a nice guy. He's real easygoing. He's a hard worker. He's really kind of a gym-rat type guy and him and I have become good friends in the last year for sure."

NOTES: DT Phil Taylor (calf strain) and TE Kellen Davis (knee strain) returned to practice on a limited basis. Taylor took part in individual drills and was held out of team sessions. ... His best songs like "After Midnight," ''Cocaine" and "Call Me the Breeze" were towering hits ? for other artists. Eric Clapton took "After Midnight" and "Cocaine" and turned them into the kind of hard-party anthems that defined rock for a long period of time. And Lynyrd Skynyrd took the easy-shuffling "Breeze" and supercharged it with a three-guitar attack that made it a hit.

Cale, the singer-songwriter and producer known as the main architect of the Tulsa Sound, passed away Friday night at Scripps Hospital in La Jolla, Calif. He was 74.

While his best known songs remain in heavy rotation on the radio nearly 40 years later, most folks wouldn't be able to name Cale as their author. That was a role he had no problem with.

"No, it doesn't bother me," Cale said with a laugh in an interview posted on his website. "What's really nice is when you get a check in the mail."

And the checks rolled in for decades. The list of artists who covered his music or cite him as a direct influence reads like a who's who of the Rock and Roll Hall of Fame ? Clapton, Neil Young, Tom Petty, Johnny Cash, Mark Knopfler, The Allman Brothers, Carlos Santana, Captain Beefheart and Bryan Ferry among many others.

Young said in Jimmy McDonough's biography "Shakey" that Cale and Jimi Hendrix were the two best guitar players he had ever heard. And in his recent memoir "Waging Heavy Peace," Young said Cale's "Crazy Mama" ? his biggest hit, rising to No. 22 on the Billboard singles chart ? was one of the five songs that most influenced him as a songwriter: "The song is true, simple, and direct, and the delivery is very natural. JJ's guitar playing is a huge influence on me. His touch is unspeakable."

It was Clapton who forged the closest relationship with Cale. They were in sync musically and personally. Clapton also recorded Cale songs "Travelin' Light" and "I'll Make Love To You Anytime" and included the Cale composition "Angel" on his most recent album, "Old Sock." Other songs like "Layla" didn't involve Cale, but clearly owe him a debt. The two also collaborated together on "The Road to Escondido," which won the Grammy Award for best contemporary blues album in 2008.

Clapton once told Vanity Fair that Cale was the living person he most admired, and Cale weighed the impact Clapton had on his life in a 2006 interview with The Associated Press: "I'd probably be selling shoes today if it wasn't for Eric."

That quote was typical of the always humble Cale. But while Clapton was already a star when he began mining Cale's catalog, there's no doubt the music they shared cemented his "Clapton is God" status and defined the second half of his career.

"As hard as I've tried I've never really succeeded in getting a record to sound like him and that's what I want," Clapton said in a "Fast Focus" video interview to promote "Escondido." ''Before I go under the ground, I want to make a JJ Cale album with him at the helm."

Clapton described Cale's music as "a strange hybrid. It's not really blues, it's not really folk or country or rock 'n' roll. It's somewhere in the middle."

Cale arrived at that intersection by birth. Born John Weldon Cale in Oklahoma City, he was raised in Tulsa. Buffeted by country and western on one side and the blues on the other, Oklahoma offered a melting pot of styles. Cale leaned on those roots forms as he spent his formative years in Los Angeles and Nashville, but he also used drum machines and often acted as his own producer, engineer and session player. He'd bury his own whispery vocals in the mix, causing the listener to lean in and focus.

"I think it goes back to me being a recording mixer and engineer," Cale said in a 2009 biography on his website. "Because of all the technology now you can make music yourself and a lot of people are doing that now. I started out doing that a long time ago and I found when I did that I came up with a unique sound."

Total earnings slip on lower oil, gas prices

PARIS (AP) ? French oil company Total SA said its core earnings slid 3 percent in the second quarter as lower crude and gas prices offset slightly higher production.

Adjusted net income slipped to 2.7 billion euros from 2.8 billion euros a year earlier. The average price of Brent crude oil fell 5 percent in the quarter to $102.40 per barrel. Total's oil and gas production meanwhile rose 1 percent to 2.29 million barrels a day.

Total's net profit ? including one-off charges and profits or losses on the value of held assets ? rose 67 percent to 2.54 billion euros in the second quarter. The gain was attributed to a lower after-tax inventory effect as well as a large gain on the sale of its stake in an Italian oil field.

Revenue in the April-June period fell 4 percent to 47 billion euros from a year ago.

Total says it expects to see the first oil extraction from its giant Kashagan project in Kazakhstan during the second half of this year. It is also studying the launch of two major projects before year's end: the Yamal liquified natural gas project in Russia and the Fort Hills oil sands project in Alberta, Canada.

Outrage Over Taiwan Death Underscores Military Woes

The recent death of a conscript may not be enough to show the unpopular Taiwan President Ma Ying-jeou an early exit but the growing rage and distrust against the government and the military may further cripple the island?s already weakening defense capability.

Last Saturday, more than 30,000 people marched in the streets of Taipei protesting against the Ministry of National Defense over a 24-year-old army conscript Hung Chung-chiu who died on July 4. Mr. Hung died after being ordered to perform excessive physical activity as punishment for what his family said was an attempt by his superiors to prevent the corporal from going public on allegedly questionable behavior in his unit. Another massive demonstration is set for next weekend.

Mr. Hung died 72 hours before his scheduled discharge. He had planned to resume his graduate study at National Chengkung University upon completion of his military obligation, his family said.

Suspicion surrounding Hung?s treatment before his death stirred up anger against the government, but it was the MND?s subsequent inability to provide answers, such as disclosing missing footage of a surveillance camera where Mr. Hung was ordered to perform strenuous exercise before losing consciousness, that really infuriated the public.

Although President Ma apologized for the death and vowed to mete out ?severe? punishment for the officers involved, Mr. Hung?s family has rejected the MND?s offer of a NT$100 million compensation and demanded an swift independent probe conducted by a third party.

The death could not have come at a worse time for the Taiwan military, which is already struggling to meet the recruitment quota for the new draft system, as the government has planned to end the compulsory service requirement by end of 2014 .

The ministry?s recruitment target for 2013 is 17,447 people, but as of July 3, only 1,847 signed up and 538 are female.

?The Hung incident is deterring more people from signing up and those who do volunteer, may not be the brightest and most qualified or upstanding to serve,? said Wang Kun-yi, adjunct professor at the Graduate Institute of International Affairs and Strategic Studies, expressing concerns that the ?hooligan? culture in the Taiwan armed forces may get worse.

In the past, said Mr. Wang, most Taiwanese men and families felt serving in the military was an honorable task because the threats from China seemed real and imminent at the time.

However, the ongoing cross-strait detente, combined with the U.S.?s repeated pledge to help maintain peace in the region, the mandatory service program has come to be considered more of a nuisance by many young Taiwanese men who would rather spend 12 months furthering their studies or honing a marketable skill, he added.

Another challenge faced by Taiwan?s military is the island?s ultra-low birth rate in face of an accelerated aging population. The interior ministry estimates, by 2051, Taiwan?s above-65 group will rise to 37% of the total population, from 11.2% as of the end of 2012.

Taiwan and China had a longstanding tension after the two split amid a 1949 civil war. Although trade links between the two have boomed in recent years, Beijing stands by its intention to reclaim the democratic self-governed island, by force if necessary.

?There are increasing concerns about whether Taiwan?s military is hollowing out with problems in recruitment and retention in trying to shift from conscripts to volunteer personnel by 2015 without sufficient resources and commitment by the leadership,? wrote Shirley Kan, specialist in Asian securities affairs in a Congressional Research Service report released July 23 this year.

A 2011 report by MND states the Chinese People?s Liberation Army has roughly 10 times the number of troops as Taiwan?s armed forces with an ?absolute advantage in terms of ballistic missiles and submarines.?

In addition to the difference in manpower, the military budgets of both governments are also greatly imbalanced.

The MND report said the 2010 defense budget of China was roughly US$78 billion, compared with Taiwan?s US$9 billion.

?Yet, the People?s Republic of China?s actual military funding is somewhere between two to three times the figure it has disclosed. Therefore, the actual difference in defense budget on the both sides may reach up to 21-fold,? the report stated.

According to the revised total budget for 2013, ?the budget for MND is NT$314.50 billion?or US$10.52 billion?0.9% down from the previous year.

?I will join the military because it is hard to find a good job now the economy is so bad,? said Hu Chien-kang, a college student in Taichung, who plans to sign up for the air force after he graduates in two years.

?But is my true intention to defend my country? Not really!? he said.

A Simple Google Search Allowed This Reporter To Hack 8 Smart Homes

It's a little scary that a simple Google search allowed someone to hack into eight smart homes.?

"Smart homes" are houses that are fully wired and internet-enabled, so that owners can control devices ? like door locks and thermostats ? remotely from their desktops or phones.

A "smart homes" Google search led writer Kashmir Hill to a list of homes with an automation system from Insteon, she writes on Forbes.

Insteon allows home owners to remotely control lights, televisions, fans, garage doors, and other devices from their smartphones or computers.

Since Insteon's systems are web crawlable, they showed up in search results. Insteon also didn't require user names and passwords in a since-discontinued product.?

So from San Francisco, Hill was able to control the lights and other things in people's houses in Oregon and Connecticut.

Here's what she was able to see from the eight homes she accessed:

  • All the appliances and devices people had
  • Time zone
  • Closest major city to home
  • IP address
  • In one case, the actual street address

Earlier this year, Insteon fixed the problem and recalled the device. But it didn't tell customers that the security vulnerability was one of the reasons for it.?Insteon blamed user error for why it appeared in search results.?
