From soybeans to baseball, Henry has had success

(AP) ? John W. Henry took a backward ballclub in a dilapidated park and transformed it into a two-time World Series champion that is one of baseball's model franchises.

As the owner of The Boston Globe, he will try to turn around a newspaper that ? like many other major metro dailies ? is shedding staff, subscribers and advertisers as it makes the transition into the Internet age.

Henry agreed to buy the Globe along with the Worcester Telegram & Gazette and the Boston Metro for $70 million, a fraction of the $1.1 billion The New York Times Co. paid 20 years ago. Henry apparently made this deal without his Red Sox partners, though he said in a statement that more information will soon be available "concerning those joining me in this community commitment and effort."

The son of southern Illinois soybean farmers now worth an estimated $1.5 billion, Henry was a minority owner of the New York Yankees and the sole owner of the Florida Marlins when he led a group that bought the Red Sox for $660 million in 2002. (The original group included The New York Times, which sold the last of its 17.5 percent ownership last year.)

They soon set out to preserve Fenway Park while taking a wrecking ball to most everything else that had mired the franchise in failure for more than eight decades.

Henry, who made his money by taking a mathematical approach to the commodities markets, brought a similar method to the baseball diamond, hiring the statistically savvy Theo Epstein, then 28 years-old, as the youngest general manager in baseball history. They hired statistical pioneer Bill James as a consultant, putting the Red Sox at the forefront of the revolution that had just begun to take hold in front offices long dominated by old-time and hidebound scouting types.

But, perhaps more importantly, the new owners turned what had long been a stagnant family business into a revenue spigot.

They took NESN, which had been almost exclusively an outlet for Red Sox and Boston Bruins games, into a full-fledged sports network. (Not every effort ? like the sports-themed dating show "Sox Appeal" ? was a success.) And they spent more than $285 million turning the once-doomed Fenway Park into a modern ? well, as modern as a 100-year-old ballpark can be, anyway ? sporting venue.

With seats above the Green Monster and a roof deck in right field, a high-tech scoreboard and new concourses and concessions, Fenway sold out 820 consecutive games ? by official count, anyway ? the longest such streak in professional sports history. Thousands more file through the turnstiles 12 months a year, paying up to $16 just to see the park when it is empty.

Though fans sometimes chafed at the team's new businesslike approach, the initiatives helped pay for a player payroll that grew from $75.5 million in 2000 to more than $130 million by 2004. That year, the Red Sox won the World Series for the first time in 86 years, ending one of the longest title droughts in sports.

They won again three years later.

Henry was also a different kind of owner than Bostonians had grown accustomed to.

While most owners of the local franchises had treated their teams like family fiefdoms or corporate cash registers ? or both ? Henry engaged with fans, chatting with them on Internet message boards (he would also became an early adopter on Twitter). He spent less time in his luxury box and more in his dugout-side seats, and was once seen running the bases on the Fenway diamond with the woman who is now his wife.

And Henry kept looking beyond baseball.

Through a sister company, the Red Sox owners bought into NASCAR as co-owners of Roush Fenway Racing; soccer, by purchasing the Liverpool FC of the English Premier League; and basketball, through a sponsorship deal with LeBron James. Their business offshoot, known as New England Sports Ventures, has also dabbled in marketing for college sports and professional golf.

In buying a newspaper, Henry enters an industry in turmoil and joins a progression of publishers who have tried to figure out how to balance the free-flowing information of the internet with the costs of quality journalism.

While providing no clues, Henry vowed to try.

"The Boston Globe's award-winning journalism as well as its rich history and tradition of excellence have established it as one of the most well-respected media companies in the country," he said in his statement. "This is a thriving, dynamic region that needs a strong, sustainable Boston Globe playing an integral role in the community's long-term future."

Japan's H-II Rocket Launches the HTV4 Spacecraft to the Space Station, NASA

"The Japan Aerospace Exploration Agency's (JAXA) HTV-4 Transfer Vehicle launched from the Tanegashima Space Center in Japan for a rendezvous with the International Space Station.

Once there, the HTV-4 will deliver 3.6 tons of dry cargo, water, experiments and spare parts to the International Space Station. Unlike a Russian Progress vehicle which docks automatically, the HTV-4 will be captured by the Canadarm2 and berthed to the Harmony module. The cargo spacecraft will be commanded to fly within about 40 feet and then hold where Flight Engineer Karen Nyberg will operate the Canadarm2 during the approach and rendezvous of the space stations latest visitor."

Cars banned as Rome moves to protect Coliseum - World News

Pedestrians swarm around the Coliseum in Rome Saturday after cars were banned from part of the Via dei Fori Imperiali.

ROME -- The Coliseum in Rome was arguably the most beautiful traffic circle in the world. For decades, thousands of cars and vespas zipped around the ancient amphitheater every day. But from Saturday, all that is history.

Exhaust fumes slowly blackened the amphitheater?s once shiny marble, and experts worried the tremors caused by traffic could threaten the fragile monument.?

Part of Via dei Fori Imperiali -- the spectacular cobblestone avenue that leads to the Coliseum -- was closed to traffic apart from public transport Saturday and turned into the ?most stunningly beautiful boulevard in the world.?

Romans and tourists will finally be able stand in front of the most famous symbol of ancient Rome without fearing they will be run over by impatient motorists -- though some nearby roads are still open.

?Visitors will walk where Julius and Augustus Caesar walked, in the shadows of the Campidoglio Hill and magnificent Coliseum,? Ignazio Marino, the newly elected mayor of Rome, said. ?In this location of truly stunning beauty, once more we witness history in the making.?

In a way, Marino has made history of his own.

The pedestrianization of Via dei Fori Imperiali and the Coliseum has been a talking point for decades, but the idea never took off due to the absence of alternative routes for the 1,200 motorists an hour that used it during peak times.

However, Marino turned his election pledge into reality just seven weeks after he took office in June.

?The project came about and has developed thanks to the participation of the men and women of Rome, as a measure which shall enhance quality of life and kindle a new-found love of the city,? Marino boasts on the official project website.

But not all ?men and women of Rome? think the pedestrianization will ?enhance the quality? of their life.

Hundreds people who live on or around roads that will take the bulk of the diverted traffic oppose the project and blame Marino for throwing them to the lions.

On nearby Via Merulana, an avenue already plagued by heavy traffic, smog and noise pollution, locals shook their heads at the sight of police reducing parking spaces to make room for the expected increase in traffic.

A hundred yards away, city council workers drew an extra lane, turning the already bustling road into a kind of inner-city highway.

Fearful that the fast-moving traffic, lack of parking spaces and the general ensuing chaos would drive clients away, angry shopkeepers and others formed a pressure group to stop, or at least modify, the project.

?This can only end badly for us,? Michele de Angelis, a local newsagent, said. ?With fast-moving traffic, nobody is going to be able to stop by, even to buy a newspaper. And traffic will be so bad soon people will simply decide to avoid the area.?

Despite the residents? fears, Marino plans to press on. He plans to kick out the mobile food carts, illegal vendors and costume-clad wannabe gladiators who turned the amphitheater into a tourist trap.

And next, he dreams of closing down surrounding areas to traffic, including the bustling Piazza Venezia.

Marino also hopes to get money from the European Union to start digging in around the forum to turn it into the ?biggest archeological area in the world.?

He may have been mayor of Rome for only seven weeks, but some see a hint of the emperors of old in his ambition and drive.

Edison Int'l Beats Earnings on SCE

Edison International?s (EIX) adjusted earnings of 79 cents per share for the second quarter of 2013 were well ahead of the Zacks Consensus Estimate of 66 cents by 19.7% and the year-ago quarterly earnings of 56 cents by 41.1%.

The beneficial results were driven by a robust operating performance from Southern California Edison (?SCE?). This was attributable to higher authorized investment in its electric grid infrastructure and favorable tax benefits.

On a reported basis, the company incurred a loss of 29 cents per share compared with earnings of 22 cents in the year-ago period.

Operational Highlights

Edison International's second quarter revenue was $3,046.0 million, up 14.8% year over year. The top line also exceeded the Zacks Consensus Estimate of $2,557.0 million by 19.1%.

Operations and maintenance expenses inched up 1.7% year over year to $967.0 million. Total operating expenses were $2,140 million, up 39.6% year over year.

Segment Results

Southern California Edison?s second quarter adjusted earnings boosted 42.4% to 84 cents per share from 59 cents earned in the year-ago quarter. The results were driven by timing and tax benefits from incremental repair deductions and lower operating expenses.

Effective Dec 17, 2012, Edison International no longer consolidates the earnings and losses of Edison Mission Energy (?EME?) due to EME filing voluntary petitions for relief under Chapter 11 of the Bankruptcy Code. EME and its subsidiaries retain control of their assets and are authorized to operate their businesses as debtors-in-possession under the jurisdiction of the Bankruptcy Court.

Edison International has recorded a full impairment of the investment in EME as a result of deconsolidation, recognition of losses previously deferred in accumulated other comprehensive income, a provision for losses from the EME bankruptcy, and estimated tax impact related to the expected future tax deconsolidation and separation of EME from Edison International. Results for Edison Mission Energy are reported as non-core discontinued operations.

Edison International's parent company and other segment digested a quarterly loss of 5 cents per share in the reported quarter versus a loss of 3 cents in the year-ago quarter.

Financial Update

As of Jun 30, 2013, cash and cash equivalents were $148.0 million, down from $170 million as of Dec 31, 2012. Long-term debt was $9,630.0 million (including current portion), up from $9,231 million at the end of Dec 31, 2012. Net cash provided by operating activities during the first half of the year was $1,261.0 million versus $1,160.0 million in the year-earlier period.

Guidance

The company maintained its core earnings per share guidance in the range of $3.25 to $3.45 for 2013. However, it has updated its basic earnings to $2.22 to $2.42 per share from the previous $2.01 - $2.59 range.

Peer Results

Recently, diversified utility, NiSource Inc. (NI) posted net operating earnings of 23 cents per share in the second quarter of 2013, a penny or 4.2% lower than the Zacks Consensus Estimate. Earnings were however 4.5% higher than the year-ago quarter.

Informative, earnest, but less than briskly paced.

"Blackfish" makes a compelling case that the cruelty of life in captivity is the cause for a rash of fatal attacks by orcas on their trainers, aggressive behavior that no so-called killer whale ever has exhibited in the wild.

Its ultimate message is clear: Killer whales belong with their families in their natural habitat, not performing for audiences. After listening to this film's many impassioned voices, it's hard to argue.

It not only delivers astonishing, suspenseful footage that makes it a legitimate thriller, but also serves up thoughtful meditations about using wild animals for our own entertainment.

It's hard to imagine anyone coming out of this movie and not swearing off the next vacation trip to Orlando, San Antonio or San Diego.

Unfortunately, this feels like a ten-minute news segment blown up to theatrical proportions.

An engrossing look at animal behavior.

It is gripping and thought-provoking.

As enlightening and passionate as the picture is, Cowperthwaite fails to summon the type of comprehensive journalism this type of story deserves.

The one save-the-whales movie to see when you only have time for one.

There aren't too many animal-rights documentaries that could be described as "metal," but Blackfish, one part horror movie and one part nature film, fits the bill and then some.

Cowperthwaite juxtaposes to devastating effect official PR spin with news reports and eye-witness accounts of marine park tragedies.

[An] impressive, often gripping documentary ...

Engrossing when offers alarming CSI-type forensic analysis into the death of a whale trainer [but] the narrow focus on SeaWorld raises more questions that aren't considered.

Through interviews with whale scientists and several former Sea World trainers, [Cowperthwaite] paints a disturbing picture of the profit-minded climate of deceit that prevailed at the company.

Puts 'killer whales' into wildlife and humanitarian perspective while giving you all of the dangerous action sequences you could possible want. Free Willy, it ain't.

Blackfish marries biography, activism and psycho thriller into a pleasing cinematic shape, starting with a single whale and the trainers who worked with him.

Some of the archive footage is exceedingly harrowing, but the case against commercially condoned cruelty is made without sensationalism, and few will be able to watch this without a growing sense of outrage.

Cruelty begets cruelty and whales don't belong in the circus.

It is never less than gripping, and devastatingly undermines the notion of performing whales as wholesome family entertainment.

Damning and disturbing viewing.

Bob Hope, who entertained millions of troops, remembered in new exhibit at WW II museum

NEW ORLEANS - Bob Hope entertained 11 presidents at the White House, hosted the Academy Awards 19 times and told thousands of jokes to some 10 million U.S. troops over the course of four wars.

Now the long life and legacy of the beloved actor and comedian, who died 10 years ago at age 100, is being celebrated at the National World War II Museum in New Orleans, where the World Golf Hall of Fame & Museum has brought the "Bob Hope: An American Treasure" travelling exhibition.

More than 160 mementos from Hope's life capture his passion for golf, relationships with presidents, pride in his country and appreciation for military service. The exhibit officially opens to the public Saturday, though a soft opening will be held Friday during regular museum hours.

The exhibit includes vintage photographs of Hope entertaining troops at USO shows overseas, an honorary Oscar statuette and PGA of America money clip. But the highlight is Hope's jokes, which are printed on displays and included in video clips throughout the exhibit.

"It was important to make it funny," said Jack Peter, senior vice-president of the World Golf Hall of Fame and Museum, who was in New Orleans for the opening. "That was one of the requests of the family."

And funny it is.

"I left England when I found out I couldn't be king" is the Hope quote in the section of the exhibit about his immigration to America from England as a young boy.

"He was very proud to be an American immigrant, that he was able to come here and succeed, and he wanted to give something back," said Anthony "Tony" Montalto, Hope's longtime accountant, who over the decades became a good friend and remains a trustee of Hope's estate.

There are pictures and jokes of Hope's time spent playing golf with presidents Dwight Eisenhower, Gerald Ford, Ronald Reagan, Richard Nixon and others.

"He's played golf with more presidents than just about anybody," Peter said.

The exhibit also includes a plaque of Hope's induction into the U.S. Blind Golf Association Hall of Fame and his name tag proclaiming him an "active member."

"When I miss a shot, I just think what a beautiful day it is ... then I take a deep breath. I have to do that. That's what gives me the strength to break the club," Hope is quoted as saying.

Jokes aside, the exhibit also captures Hope's appreciation for military service. There are pictures of him shaking hands with injured troops, some who had lost limbs but had smiles on their faces. There are pictures and video of Hope entertaining on stage during World War II, Vietnam and other wars.

"This brings another aspect of the war that we're not always able to tell through our permanent exhibits," said Toni Kiser, the National WWII Museum's curator who put the exhibit together. "It was really important to the troops to get rest and relaxation, and not only did they love to be entertained with music and comedy, it was necessary for them to have that down time, to not be in fight mode the entire time."

Hope, it seemed, knew that.

"I have seen what a laugh can do," he is quoted as saying, in the exhibit space with pictures of him with wounded troops. "It can transform almost unbearable tears into something bearable, even hopeful."

The exhibit will remain on display in New Orleans through Oct. 31.

Is private equity bullish on India real estate once again? - Firstpost

Even though private equity investment in the Indian real realty has?fallen nearly 50 percent to $276 million in the first half of 2013 due to lack of good projects and weak sentiment, foreign investors are still bullish on the sector.

According to property consulting firm Cushman and Wakefield?about $2 billion (Rs 11,854 crore) is available with private equity firms ready to be deployed in real estate in the next one year, but PE funds want to put in money only in those projects with strong fundamentals.

?While the PE investments in real estate was recorded at $276 million (Rs 1,638 crore) in H1 2013, which is 46 percent lower when compared to first half of 2012 ($ 514 million/Rs 3,050 crore), the PE funds continue to show keen interest in the market with a number of deals in discussion,? C&W said in a statement.

According to?C&W Executive Managing Director of South Asia operations Sanjay Dutt, despite the slowdown in the construction market and the reduced number of investible projects in India, real estate is still the fourth most-invested sector by private equity funds.

?We anticipate that in the next few quarters, after some regulatory and politico-economic environment are regularised, the momentum in real estate will pick up throwing open more investible options for the investors,? he said.

So far?in 2013, the highest value PE investment was $131.6 million in Pune, followed by $67.5 million in Mumbai, $38.8 million in the National Capital Region, and $16.9 million in Bangalore.

Even data from Venture Intelligence shows that private equity-Real Estate firms made 13 investments (amounting to $318 million across 12 deals with disclosed values) during the quarter ended June 2013.?The volume of investments perked up significantly from the seven investments in the same period in the previous year (which witnessed $172 million being invested across six transactions with disclosed values) and also the eight investments (worth $569 million) during the Jan-Mar 2013 quarter.)

Data provided by the firm shows that?Ascendas Trust?s Rs 600 crore (about $110 million) acquisition of 2 million sq. ft of office space in Hyderabad from Phoenix Group was the largest investment during the second quarter of FY13. This was followed by Xander?s Rs 280 crore ($52 million) investment in Supertech?s 125 acre township project in Gurgaon and Clearwater Capital?s (along with Ajay Piramal Group non-banking financial company PHL Finance) Rs 300 crore ($50.2 million) investment to finance VGN Developers? acquisition of a land parcel for a gated community project in Chennai.

Earlier this week, Kotak Real?Estate fund said it had raised $200 million (Rs 1,200 crore) from select group of investors and has firmed commitments to raise $200 million more to close its $400 million ?eight-year tenure fund to invest in only residential properties in India?s six metros. ?The ?fund will?invest an average of $15-20 million in each project and will put in money from the first close in 10-12 projects. It is looking to generate a return of 20 percent for investors of the new fund.

Even Tata Realty?has put its 780,000 sq ft IT park in Mumbai?s Goregaon suburb on the block and aims to raise Rs 800 crore through the sale of the park, while?Oman?s State General Reserve Fund and the Government of Singapore Investment Corp (GIC), investment firm Temasek committed to invest $200 million in HDFC Real Estate Fund.

There's not much to reveal about Panasonic's Lumix DMC-GX7 since it leaked (nearly) in full just days ago, but now it's official. This 16-megapixel Live MOS shooter is Panny's latest Micro Four Thirds offering aimed squarely at prosumers. This retro-styled camera is a much svelter option than the video-focused GH-3 ($1,500) thanks to its magnesium alloy casing. Along with in-body image stabilization and a swift shutter that tops out at 1/8000th of a second, the ISO tops out at 25,600. If video is your concern, it'll capture 1080p footage at 60 fps (24 Mbps) in AVCHD.

While the GX7 will burst shoot with autofocus tracking at 4.3 fps, its electronic shutter lets it hit 40 fps if pure speed is what you're after -- while we're on it, the shutter will also operate in a silent mode. Notably, a vertically-tiltable 16:9 Live View Finder is onboard, packing a resolution of 2.76 million dots and the ability to fire off the autofocus once it detects an eye. Two control dials aid in manual settings along with a rear-facing LCD touchscreen, which tilts up to 80-degrees. If all that wasn't enough, built-in WiFi and NFC allow for the likes of remote viewfinder apps and sharing media.

The GX7 will hit the US this November in a silver and black colorway priced at $1,100 with a 14-42mm kit lens, and $1,000 for just the body itself. A sleathier all-black variant will also be available, though only in Japan. Aside from the camera, a new Lumix lens with Leica tech will also hit shelves, offering a 45mm 42.5mm focal length with a speedy f/1.2 aperture -- the fastest in the lineup to date. Using video-based support groups for rural women with breast cancer

rural California2Support groups can help women with breast cancer reduce pain and emotional distress, while providing a source of encouragement, camaraderie and advice. Yet, as I explained yesterday in a?press release, joining support groups?is often impractical for breast cancer patients?who live in remote areas:

?Women in rural areas have a hard time finding other breast-cancer survivors,? said?[Cheryl Koopman, PhD, a professor of psychiatry and behavioral sciences]. Many wish to communicate with one another, but they can face a number of challenges ? such as snowed-in mountain passes, limited public transportation and high travel costs ? simply getting to support groups, which frequently are located in major cities. Moreover, patients are often too fatigued from cancer treatments to make the trip.

This is what prompted the Sierra-Stanford Partnership, a collaboration between rural-community advocates Joanne Hild and Mary Anne Kreshka, of the Sierra Streams Institute, and Stanford?s Koopman. The collaborators are now seeking breast-cancer patients living in one of 27 northern California counties to participate in a study of the effectiveness of support groups conducted via video chat.

This form of support group is different from Internet support groups, because it?s more personal, Koopman told me:

Text-based, Internet support groups are already available, but many patients want a more interactive form of communication. ?A lot of women tell us they would like to see the support-group leader and one another,? Koopman said. The strength of the video-based support group is that breast-cancer patients can see and interact with one another with minimal cost and effort, she said.

The ultimate goal is?to help researchers design the best kind of support group for breast-cancer patients who live in rural areas. Information for volunteers interested in participating in the study can be found here.

Dicerna raises $60M, will test cancer drug in trials

Watertown-based Dicerna Pharmaceuticals today announced it had closed a $60 million funding round led by new investor RA Capital.

Dicerna?s CEO, Douglas M. Fambrough, said the company will use the money to advance it?s cancer drug, DCR-M1711, to clinical trials with humans.

?The first program we?ll test is a gene researchers have known about for 35 years,? Fambrough said. ?It?s a gene that?s inappropriately turned on, driving cancer, and researchers have never had a way to turn it back off.?

Dicerna has been working on the concept for about four years, he said, and about a year ago, it began to test the drug in animals.

Using the new funding, the company will begin two clinical trials ? each with 35 to 40 people ? early next year, Fambrough said.

One trial will treat people with different types of tumors, he said. The second trial will treat people who have liver cancer.

?We think it?s particularly likely it will work best in liver cancer patients,? Fambrough said.

If the drug does well, it will advance to larger trials and could be on the market in five years, he said.

?We?re talking about cancers that kill people,? Fambrough said. ?We really want to get things done quickly. But five years is fast in cancer research.?

McLaren driver Jenson Button has said that he felt like a target in the 2013 Hungarian Grand Prix as he was hit by two drivers, Sebastian Vettel of Red Bull Racing and Romain Grosjean of Lotus, during the race.

Button struggled a lot during the qualifying of the Hungarian GP and failed to make his way into the final session. Afterwards, he had a contact with Vettel who tried to pass him after taking the pit stop on lap 17. Then, the British driver had a collision with Grosjean on lap 24 at the chicane. Despite facing immense difficulties, he managed to secure an incredible 7th place finish and managed to score some good points for his team.

The 2009 world champion said that although he really enjoyed racing at the Hungaroring, he felt that he was being targeted by the German and the Frenchman. Nonetheless, he asserted that he is feeling lucky he didn?t face a tyre puncture and completed the race successfully. ???

?It was a fun race but I seemed to be a target for a lot the race,? Button said. ?I know I'm slower but I seemed to be a target for Sebastian and Grosjean too.?

?Sebastian couldn't get past initially and then tried to dive up the inside, but he didn't even have a wheel alongside and he tapped my rear wheel with his front wing. Luckily it didn't give me a puncture but I damaged his front wing,? he said.

?Grosjean had a little go as well,? the British driver added. ?I was basically there with my arm out the cockpit almost saying ?What are you doing???

In addition, he expressed that he is feeling immensely pleased to secure 7th place finish in the preceding race and is positively looking forward to perform well in the season ahead. Presently, he is standing at 9th place in the drivers? championship with 39 points. At present, he is ahead of Paul di Resta of Force India and behind his major opponent, Grosjean.

It will be exciting to see how the Briton shows up in the approaching races.

Documents required for a secure real estate transaction

It pays to be cautious; especially when dealing with murky state of affairs pertaining to real estate transactions. No amount of scrutiny would suffice while purchasing a property. Due to the existing state of affairs, especially in the absence of a regulator or a real estate bill there is always a confusion when it comes to documents regarding the property.

The following are the documents that should be checked and thoroughly inspected before and even after buying/selling a property:

?

Written agreement

A written agreement should be imperatively provided by the developer. The agreement should acutely mention the all the terms and conditions, specifications of the apartment, time of delivery and the payment plan.?The agreement should additionally mention the exact quantum of penalty to be imposed in the event wherein the developer fails to meet the construction deadline as well as in the event wherein the buyer defaults on the payment schedule.

In the case of buying a house within a completed project, the occupation certificate, electricity and water connections, fire safety equipment and mechanism and property tax receipts for the project should be physically checked by the buyer. In particular, the occupation certificate issued by a government authority is very substantial.

Employing the services of a bank:

Buying a flat through a bank loan is the best course of action. Since the bank accepts the apartment which is yet to be constructed in a new project, as collateral, they do all the checks, including the builder?s credentials, to ensure that the collateral?s market value does not diminish.

Buyer-seller agreement:

This agreement includes each and every clause, conditions, terms and legal implications for the buyer and developer should there be a default on either side. Prominent points are interest, default charges for a buyer, penalty and clauses of refund of payment in case the project is not completed or is scrapped.

Also, the penalty in case of any structural defects or delay in construction as well as a clause to transfer the common undivided land to the society and owners to ensure that further construction or development cannot be undertaken by the developer once the completed project is handed over, should be included within a registered agreement.

Documents:

For Delhi:

Perpetual lease deed, Conveyance deed, Sale deed in case of resale properties, Mutation paid, Last paid house tax receipt, Last paid electricity and water bills, Completion certificate and Sanctioned plans.

For Noida/Greater Noida:

Allotment letter from Noida Authority (in case of a plot or flat built by authority), Registered perpetual lease deed, Proof of payment of lease rental, one-time or yearly; Transfer memorandum and registered transfer deed in case of resale property, NOC from Jal Department, Share certificate and NOC from society (where applicable as some old sectors or group housings have been allotted to societies), Completion certificate for houses with sanctioned building plans and Mutation letter in name of current owner.

For Gurgaon:

Allotment letter (in case of either HUDA or DLF properties ? builder-buyer agreement), Registered sale deed in name of current owner with all originals from previous owners, Sanctioned building plans and completion certificate in case of independent houses, Mutation letter from DLF or HUDA, Proof of up-to-date payments of power and water and house tax charges, NOC from RWA or maintenance office in case of group housing.

Titles and documentation:

In case the property is purchased from the urban development authorities, the risk of clear titles and documentation decreases by a significant margin.

Howbeit, one should seek legal assistance to check documents related to land ownership, allotment letter, licences and approvals, sanctioned plans etc, if the flat is being purchased either from a colonizer or private developer.

Certificates:

Certificate from society:

The share certificate issued by a society should be checked by the buyer, as it establishes the seller?s identity. The share needs to be transferred in the name of the purchaser. This certificate forms a part of the ownership deed.

NOC from society:

In case of a resale, the no objection certificate (NOC) which is issued by the society should be verified. This NOC states that dues payable by the seller to the society are nil and that the conditions laid down by the society have been complied by the seller.

Ownership titles for group housing cooperatives:

Essentially, the ownership documents allotted or the shares transferred should be verified to ascertain the legal rights.

Title papers:

In case the property is being purchased directly from a builder, the title papers should be checked as it proves the owner?s identification. The document can also be used to determine whether property has a clear title or if its under litigation, whether the seller possesses the authority to develop or sell the property, whether the land is on leasehold or freehold as well as indicate whether the property is free of encumbrances. If there is a conveyance deed favoring the seller, then it ensures that the property has a clear title.

Checking by bank:

If the property is being purchased through a bank loan, the bank would normally appoint its own lawyer to verify the title deeds. Or, a lawyer can be hired and a request for originals can be placed with the bank. In any case photocopies of the documents should not be accepted.

Municipal clearances:

The completion certificate which is issued by the municipal authorities is another important document. It proves whether a building is in compliance with the rules and regulations in respect of distance from road, height, besides other things. The occupation certificate should also be verified as it certifies that the electrical connections, sewage and water are in place.

Development agreement:

In case the property has been constructed jointly by the builder and the owner, the joint development agreement which mentions the terms of development of the property.should be scrutinized.


Purchase agreement:

The purchase agreement between the developer and the authority or the agency from which the developer has bought the land too needs to be scrutinized. It ensures the seller (builder) has the authority to sell the property, and it also states if the property has any mortgages against it.

List of approvals:

Noncompliance in getting legal approvals from a number of authorities may result in scrapping of the project or reduction in the market value. The approvals to be obtained are structural safety certificate, building plans and floor plan approvals, no-objection certificate from the civic authority, urban land ceiling certificate, environment clearances, commencement certificate and title deed. The buyer upon possession, should physically check the occupation certificate, water and electricity connections, fire safety equipment and mechanisms and property tax receipts.

San Diego Mayor Bob Filner is asking the city to pay his legal expenses for a sexual harassment lawsuit filed by his former communications director. Filner?s lawyer sent a letter to the city, imploring it to cover the mayor?s legal bills in a lawsuit that accuses him of asking his former female aide ?to work without panties? and other alleged acts of sexual harassment.

City council members?who overwhelmingly want Filner to resign?are scheduled to convene Tuesday night for a special closed session to consider the mayor?s request.

Under California law, Filner is allowed to set up his own legal defense fund in the case the city rejects his request. Filner?s lawyer,?Harvey Berger, argues that his client should be defended under the city?s expense. The letter states that Filner should have the city pay for representation under California government codes?825?and?995?? which deal with compensation and defense of public employees.

Since the claim was first filed by Filner?s former employee Irene Jackson,?seven women have publicly come forward and detailed other alleged acts of sexual harassment, including touching and kissing. In her 11-page lawsuit, Jackson claimed Filner demanded kisses and told her he wanted to see her naked.

The mayor, who is 70 and divorced, has since apologized for ?offending? women. On Friday, Filner announced that he would enter two weeks of ?intensive? therapy starting Aug. 5 to ?begin the process of addressing [his] behavior.?

Filner?s own party leaders, including California Sen. Dianne Feinstein and?House Minority Leader Nancy Pelosi,?have urged him to resign.??The conduct of some of these people that we?re talking about here is reprehensible,? said Pelosi last week about both the Filner and Anthony Weiner scandals. ?It is so disrespectful of women, and what?s really stunning about it is they don?t even realize. They don?t have a clue.?

Feinstein directly called for the mayor?s resignation and predicted a recall election for the mayor?s seat. ?It?s a very tough job, and I don?t think that somebody who is lacking a moral compass really sets a role model or really will provide the kind of leadership that San Diegans want.??Feinstein said on Sunday.
